Insurance Fraud

Insurance companies have always employed counter-fraud policies and will reject claims whenever fraud is suspected. More recently they have entered into "understandings" with the police so that there will now be more criminal prosecutions.

If you find yourself accused of insurance fraud you have more to lose than just the value of the claim. New sentencing guidelines issued to the Courts make it clear that for all but the most minor frauds a prison sentence should be imposed.

There is also the prospect of confiscation under the Proceeds of Crime Act 2002. This can lead to the loss of any assets that the prosecutor can identify is available, not just the property obtained from the offence. Specialist advice should be taken at the earliest opportunity.
